My case is - PD Nov 2007 , I-140 approved June 2008. I -485 is not applied. Can I change Job on this basis and still maintain my Priority date ?

BTW : Current company lawyer does not give copy of receipt of I-140 ( says its company property) though I know the LIN #.

They copy china dates. They did the same thing last time. I think their program needs a fix. They will change it manually eventually. But in the meantime if you want to rejoice in hope feel free. I did that last month. I knew I was kidding myself but then thought, why not indulge myself.
Three years back I dreamt my labor got cleared. Labor mind you not GC.Even in my dreams I don't see that. I was delighted. I was aware I was dreaming(One of those lucid dreams) but I let it continue. It felt good for a while. This is the same thing. Have fun

My Situation:
Dentist working in a Non-Profit organization for 4yrs.
EB3
PD: Aug 2006
LC - Approved
140 - Approved
485 - Filed Aug 2007
485 RFE for EVL - Submitted.
EAD (2yr) and AP - Approved

After submission of RFE, I got accepted into a 2yr speciality program that is one of a kind and I have been waiting to get into this for a long time, and it is like a dream getting accepted.

I am presently in the program and I received the following update.

I will be starting to work with the sponsoring employer from July 2009 on a part-time basis. My relation and communication with the sponsoring employer is very good.

I am planning to join the sponsoring employer after my 2yr program and my employer is willing to accept me, but they cannot provide a future job offer as they cannot say if there will be a job opening.

I am sure I will be called in for an interview. I have exhausted my 6yrs of H1B and presently working on EAD.

I am little concerned for the interview, as I do not work full time and do not have a future job offer. But, since I am working part-time with the sponsoring employer, will that help to prove that 485 was a legitamate.

I would greatly appreciate if someone could please throw some info.

pani_609-17 08:03 PMI forgot to mention one thing..my h1 was done by an university ...in 2002 when this quota was not there....just because its done by an university..I cannot assume it came under a non quota-exempt...since this was done when the quota system was not in existence...
SO can I request a h1?? right away

But she stays more (like 6 month max) for each visit, after 2 such visit, within a small gap say 2-6 months, there is a chancce to blacklist her and may be allow for 1-2 months I-94, or deny her entry. They are smart to see the intension of people. They look for the pattern of visit.

But the strange thing is, I did get an EAD approved but they never called me in for fingerprinting and Biometrics. I know I had to do the non-immigration "registration" that was initiated a few years ago and they had taken my fingerprints and biometrics, is that why they didn't call me in again? since they already have it?

My 6 years on H1B is going to expire in Oct 10. I want to file for extension but the lawyer says that i can do it only after Mar 10 that is 6 months before h1b expires.

I have to visit my home country in May 10 and i wanted to go with my new h1b documents.

Can you please suggest if i can file now or is there really a timeframe before we file?

Sorry forgot to mention, I have approved I140.

The updated Web site is organized according to categories.The categories are displayed as Topics, Forms, Resources, Laws, News, and About Us. The topics are categorized as follows: Adoption, Permanent Residence, Humanitarian, Citizenship, Members of the Military and Their Family, Family, Visit the U.S., Working in the U.S, and Genealogy. After clicking on a specific topic, I was provided helpful information and even more additional information was available through the links on the left of the screen.The advantage of categorizing the information by topic is that individuals are now able to familiarize themselves with the process from start to finish. There are other helpful links and tools within each specific topic.

Another key feature to the Web site is that there is a “where to start” link. I have a h1b stamping appointment at the Chennai Consulate on the 29th of Nov.

I am in my 7th yr of h1b.My 3 yr extension has been approved based on aprroved I-140.

I have a question on the approved I-140.I do not have the original I-797 for my I-140 approval.

Will I need it for the interview?

I have the original I-797 for the h1b extension approval but not for the I-140.I only have a copy.

My company immigration team said its not needed.

is this correct?

uma00104-26 10:16 AMI have a query related to entitlement of salary and back wages. I was laid off by a big MNC software company based in Texas in Oct 2009 . Just in span of 1 week , i was offered a position by desi consulting company starting November 1 . They started my H1 transfer process stating starting date as November 1 on LCA petition . I was told to wait until H1 receipt comes and client gives green signal to start the project.
Even after getting the receipt on 30th November , i was never sent on project neither paid .
I waited till 31st December and left the country on 1st Jan 2010.

What are my rights ? Am i entitled to get the back wages as stated on LCA petition because i was never paid by employer till date ?
What is the duration period i could get the salary ?

Please let me know the process to get my pending salary if i am entitled to get any

Person A : PD august 2005 and I-485 filed on : 15 th july
Person B : PD august 2006 and I-485 filed on : 2 nd july

who will get GC first ? Person A or person B ?
