Not sure why you are worried about it? This is no different from the other vaccinations you were given as a child that you had no choice on.

I am from the UK and every child was given the BCG vaccine for decades, normal course of growing up.

Here is my situation and I really appreciate your advice:

I have filed my I-485, EAD, and AP thru my employer (consulting company) in EB3 category. I have received my EAD and AP but i havent invoked AC21.

I also have approved labor (PD--01/2006), and approved I-140 in EB2 category thru my client's company.

Since, EB3 category is not going anywhere, I am thinking of filing another I-485 thru my client in EB2 category.

1) Is it possible for me to file second I-485 in EB2 category while first I-485 is waiting for approval?

2) Can i port my EB3 PD (12/2003) while filing 2nd I-485 thru client?

No need to file 2nd I-485.

Just update your existing I-485 with 2nd I-140 and claim earlier PD. You can claim PD with EB2.

Your lawyer should be able to do that.

goingtoindia03-30 01:51 AMMy I-485/I-140 were filed on Jul 2, 2007 (I-140 approved in 9/2007). I possess an EAD valid till Sep 2010 and AP valid till Aug 2009. I lost my job (H1B) in late January. I have a family emergency compelling me to travel to India for a week (starting Saturday next week 04/04/2009). Will there be any problem in terms of using my AP to re-enter the U.S? An early reply would be appreciated. Thank You very much in advance.

P.S: I do not have a job yet.

My friend got laid off on Dec 19th 2008. And he got another job, but the new employer is not providing him Group Health Insurance. They are asking to take him Individual Family plan and saying they will reimburse. But the problem is, he is in Albany, NY and he got to know that they are no individual plans in NY which is really odd.

He wants to use COBRA but it's really expensive 1200$ per month. But luckily we saw that there is a 65% discount for people who laid off between 1st Sept 2008 and Dec 31st 2008.
But want to know whether H1b employees are eligible for this discount or only American Citizens and Green Card holders?

It is not advisable for her to leave the country without AP on hand. It is a risky proposition. Normally USCIS checks internally the resident status of the person and if they come to know that she left the country already, they may say/ consider that she left USA with the intention of abandoning her AOS case and issue denial for her I-485.

H1b visa on passport expired on Apr/2009. Have approval until Apr/2010. Applied for 3 year extn in Nov/2009 under PP.

An RFE is raised against the H1b extn (which was applied in Nov/2009). I have vacation planned starting 14Dec/2009; with just 3-4 months left on approved H1b papers, is it advisable to travel to India and do the stamping in HYD? Or am I risking my return to US?

My H1-B 6 yr limit will expire by January 2010. What are the risks to my immigration status if my company is acquired by a bigger firm?

1. Will I have to re-file for PERM again with the new company?

OR

2. Can I continue under the already audited PERM in smaller company's name?

Do I have to wait for 180 days before I change employers and start using the EAD (since I am the secondary applicant)? Or can I use my EAD as soon as I get it?

2. Your employer not only should not revoke your I140 but should not be using the LC for someone else. If he chooses use it for some one else the originla beneficiary will no longer get its benefits.
3. The condition for three years extension is you are not able to get to I485 because of retrogression so they will give you three years,
It is possible with a different employer only if the new LC and I140 is approved and you are waiting to file I485.

This is what I know, but I am not an attorney so better to talk to your (new) company attorney before making the move.



sundeep1407-14 04:39 PMI have 140 approval notice in mail like 1.5yrs back...just today i put the reciept number on USCIS website and it says still pending..i called USCIS and they say they wont be able to discuss my case since 140 is employer specific only....my employer is sayin dont worry and dont bother about online status...i just want to make sure my 140 is really approved and USCIS has the correct update while lookin at my 485 file...i dont want them to put my 485 in hold just because of they thinkin 140 is not approved...
