I have few questions regarding the H1B visa renewal. I hope someone who can kindly answer them.

Background - I got my H1B visa in about 2003, and I got married in Oct 2005. However, I am not able to claim my husband for the H4 visa. He is an undocumented immigrant in the U.S. for more than 10 years. So my lawyer told me that I could only help him to get greencard when I become a citizen. So I have the following questions :

When I do my first time H1B visa renewal, will my new Marriage status disturb me to get the H1B renewal? should I just simply fill in the form saying I am "SINGLE" and not tell the consulate? Will the consulate know?

I recently traveled to Canada by land for 1 week . When I went to Canada the canadian authorities did not take my I 94. When I returned from canada, the US officials did not give me a new I 94, will this be a problem ?

Of course, he wouldn't comment on how much this contributes in triggering an audit. My goal is to avoid targeted audit altogether. His (and the company's) goal is to see the PERM through successfully, even in the face of an audit. Obviously, a slight difference in goals.

The requirements in fact are normal for this company, and in the field in general. I have no doubt that this can be successfully argued. The problem is with the face-value of the BS+7 requirement against the objective O*Net criteria, and the fact that the only way to make an argument is through a business necessity audit.

At the POE the guy simply wouldn't understand when I tried to explain to him that I have an extension (797) valid from 4/10 t0 4/11. He gave me an I94 only until 4/10. I read that people go for deffered inspection and get it corrected. Anybody who did that in a similar situation active in IV now? Any suggestions on how to proceed? do you go to the nearest international airport or an off-airport location?

Thanks for starting this thread. I have just sent all the four letters even though I am not planning to use the AC21. But I feel sorry for fellow EB's who got rejected because few IO did not know about the AC-21. I get really :mad: P***** O** to see that ppl who are playing by rule have to face hardship at freak'n every stage of GC.

rajeshiv03-01 01:33 PMI was moved from state (A) to another state (B) along with Client 'Y' four years back...and my Employer didn't filed for H1 amendment at that time, but my payroll was running from State B with same salary. I was not aware of this rule to file an amendment for change in job location and I dont know even employer is aware of that or not.

After three years I got EAD and I Employed by Company X in state B.

My question is....what are my options and problems for not being filed H1 Amendment four years back.?

Please advice.

2. If your current visa is not expired, you can delay in filing I-485. Just file I-130 now.

My lawyer sent a letter to USCIS and they personally responded along with sending the RN for her 2 weeks ago.

josecuervo07-24 01:41 PMI e-filed EAD renewal. On the I-797 Notice of Action that they mailed me, the "Priority Date" field is blank. The same is true for my last EAD notice of action as well which I did not check last time. Is it normally blank?

Is anybody else in the same boat?

I checked my receipt notice. PD is blank. I checked with a friend of mine and his receipt notice PD is blank too.
BTW mine is paper based filing.
